1. Agreement to Terms

By accessing or using the True Blue Horizon platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including vessel owners, operators, and authorized crew members.

2. Description of Service

True Blue Horizon provides a vessel intelligence platform that enables owner-operators of recreational yachts to monitor and interact with their vessels through natural language. The Service includes:

• Real-time telemetry monitoring via Signal K-compatible sensors
• AI-powered conversational interface for querying vessel status and historical data
• Analytics dashboards and historical data visualization
• Trip logging, cost tracking, and route planning tools
• Gateway hardware for collecting and transmitting vessel data

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

Accounts may be created using email and password or via Google OAuth. You may not share your account with others or create multiple accounts for the same person.

4. Subscriptions and Billing

The Service is offered on a subscription basis with monthly or annual billing cycles. Subscription tiers determine the features, data retention period, and number of AI queries available to you each month.

• Payments are processed securely through Stripe. We do not store your credit card information on our servers.
• Subscriptions renew automatically at the end of each billing cycle unless cancelled.
• You may upgrade, downgrade, or cancel your subscription at any time through your account settings. Changes are prorated.
• A one-time hardware setup fee may apply for new vessel installations.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable maritime regulations
• Attempt to gain unauthorized access to other users' accounts, vessels, or data
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access the Service without our written permission
• Interfere with or disrupt the integrity or performance of the Service

6. Vessel Data and Telemetry

The Service collects telemetry data from your vessel's onboard systems via Signal K-compatible gateways. This data includes but is not limited to engine parameters, navigation data, environmental readings, and electrical system metrics.

You retain ownership of all telemetry data generated by your vessel. We process this data solely to provide and improve the Service. Data retention periods vary by subscription tier as described in your plan details.

7. AI-Powered Features

The Service includes AI-powered chat and analysis features powered by third-party language models. While we strive for accuracy, AI responses are informational and should not be treated as professional marine engineering, navigation, or safety advice.

You acknowledge that AI responses may occasionally be inaccurate or incomplete. Always verify critical information through appropriate professional channels and use your own judgment when making decisions about vessel operation and safety.

8. Intellectual Property

The Service, including its software, design, text, graphics, and other content, is owned by True Blue Horizon and protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.

9. Limitation of Liability

To the maximum extent permitted by law, True Blue Horizon shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, loss of data, loss of revenue, or damages arising from reliance on AI-generated recommendations.

The Service is a monitoring and information tool. It is not a substitute for proper vessel maintenance, professional marine surveys, or qualified engineering advice. You are solely responsible for the safe operation of your vessel.

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms. You may cancel your account at any time through your account settings. Upon cancellation, your access to the Service will end at the close of your current billing period.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New South Wales.
