Hardware Terms & Limited Warranty

These Hardware Terms govern the purchase and use of True Blue Horizon Gateway devices and accessories (the “Hardware”). They form part of the Terms of Service.
1. Orders, Pricing & Taxes
Prices, fees, and any one-time setup or onboarding charges are displayed at checkout. Prices exclude taxes, duties, and shipping unless stated. You are responsible for applicable sales, use, VAT, GST, customs, and similar charges.
2. Title, Risk of Loss & Shipping
Title and risk of loss for purchased Hardware pass to you upon delivery to the carrier (FOB origin). Shipping times are estimates. We are not liable for carrier delays or for Hardware lost or damaged in transit after delivery to the carrier; file claims with the carrier or, if damage is evident on delivery, refuse the shipment and notify us within 48 hours.
3. Installation
You are responsible for safe and lawful installation of the Hardware on your Vessel, including compliance with applicable ABYC, ISO, NMEA, USCG, and class-society standards. Improper installation can affect performance, void this warranty, and create safety risks. We recommend installation by a qualified marine electrician.
4. Limited Warranty (12 Months)
We warrant that the Hardware will be free from defects in materials and workmanship under normal use for 12 monthsfrom the date of delivery (the “Warranty Period”).
If a Hardware unit is defective during the Warranty Period, your exclusive remedy and our entire liability is, at our option, to (a) repair the unit, (b) replace it with an equivalent unit, or (c) refund the price you paid for that unit. Refurbished replacements may be used.
Except as stated above, the Hardware is provided “as is” and we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
5. Exclusions
This warranty does not cover:
- Damage from misuse, accident, neglect, or unauthorised modification.
- Damage from improper installation or operation outside published environmental ratings.
- Cosmetic damage.
- Consumables (cables, fuses, antennas).
- Damage from severe weather, lightning, immersion outside rated ingress protection, or marine corrosion beyond design tolerance.
- Hardware whose serial number has been altered or removed.
- Hardware purchased from unauthorised resellers.
6. RMA Process
To request warranty service, email support@truebluehorizon.com with your order number, serial number, and a description of the defect. We will issue an RMA number and shipping instructions. Do not return Hardware without an RMA number. You are responsible for outbound shipping to us; we cover return shipping for valid warranty claims.
7. Returns Outside the Warranty
You may return new, unused Hardware in original packaging within 30 days of delivery for a refund, minus a 10% restocking fee and outbound shipping. After 30 days or if the Hardware has been installed or used, returns are not accepted outside the warranty process.
8. Firmware License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the firmware embedded in the Hardware solely to operate the Hardware with the Service. You must not reverse-engineer, decompile, disassemble, or extract the firmware, except to the extent permitted by applicable law. Firmware updates may be delivered automatically. Title to firmware remains with True Blue Horizon and its licensors.
Open-source components included in the firmware are listed at /open-source and are licensed under their respective open-source licenses.
9. End-of-Life & Service Dependency
The Hardware is designed to operate with the True Blue Horizon Service. If you terminate your subscription or if we discontinue the Service or this Hardware generation, the Hardware may lose functionality and may no longer receive firmware updates. We will endeavour to give at least 12 months' notice before end-of-life of a Hardware generation.
10. Regulatory Notices
FCC (United States).This device complies with Part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) this device may not cause harmful interference, and (2) this device must accept any interference received, including interference that may cause undesired operation. Changes or modifications not expressly approved by the party responsible for compliance could void the user's authority to operate the equipment. FCC ID: [to be inserted].
Industry Canada.This device complies with ISED's licence-exempt RSSs. Operation is subject to the following two conditions: (1) this device may not cause interference; and (2) this device must accept any interference, including interference that may cause undesired operation of the device. IC ID: [to be inserted].
EU / UK. Conformity declarations and UKCA / CE markings, where applicable, are provided with the product.
RoHS / WEEE. The Hardware is designed to comply with RoHS and WEEE requirements where applicable. Do not dispose of Hardware as unsorted municipal waste; return at end of life for recycling.
Battery / Wireless safety. Follow product safety instructions in the packaging. Do not open or modify wireless or battery components.
11. Limitation of Liability
Hardware liability is subject to the limitations in Section 11 of the Terms of Service. In addition, to the maximum extent permitted by law, our total liability for any Hardware claim will not exceed the amount you paid for the affected unit.
12. Magnuson-Moss (US Consumers)
This is a limited warranty. Some states do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so the above limitations may not apply to you. This warranty gives you specific legal rights; you may also have other rights that vary by state.
